When you make a payment through Stripe or otherwise accept these Terms online, you confirm that you have read, understood, and agree to these Terms of Service.
These Terms form a legally binding agreement between you (the Customer) and Switch Visual Oy (“Switch,” “we,” “us,” or “our”).
1.1 “User Content” means any text, prompts, images, videos, audio, metadata, or other material that you upload, submit, or otherwise make available through the Service.
1.2 “Model Training Use” means the use of User Content to train, fine-tune, evaluate, or otherwise improve machine-learning, generative-AI, large language models, or similar artificial-intelligence systems.
1.3 “Outputs” means content generated by the Service in response to your prompt or input, or based (in whole or in part) on your User Content.
1.4 “Subscription” means a paid plan or membership providing access to premium features of the Service.
1.5 “Third-Party Models” means foundation or external AI models maintained or licensed from third-party providers (e.g. OpenAI, Google, Anthropic) used within the Service.
1.6 “Confidential Information” means non-public information of a party disclosed to the other that is marked or reasonably understood to be confidential.
1.7 “Agreement” means these Terms together with any applicable order form, data-processing addendum, or supplemental terms.
1.8 "Managed Services" means AI-generated content creation and AI-powered automation or agent services performed by Switch's personnel on behalf of the Customer.
1.9 "Self-Service Platform" means Switch's online software tools that allow Customers to independently access and deploy AI-generated content, automated workflows, and AI agent capabilities.
1.10 "Deliverables" means outputs produced by AI agents operating through the Managed Services or Self-Service Platform, including but not limited to AI-generated content, automated task results, and creative assets such as images or videos.
1.11 "AI Agent" means an AI-powered software system that autonomously or semi-autonomously executes tasks, workflows, or decisions on behalf of the Customer using tools, data access, or external integrations.
